Terms and Conditions

1. INTRODUCTION

At Morden Driving School, we aim to provide a professional, reliable, and high-quality learning experience.

These Terms & Conditions are designed to ensure clarity, fairness, and smooth delivery of all driving lessons.

By booking lessons with us, you agree to the terms outlined below.

 

2. OUR BUSINESS MODEL

Morden Driving School Ltd operates as an agency connecting pupils with self-employed driving instructors.

  • All instructors are independent franchisees
  • The School manages standards, bookings, and policies
  • The tuition contract is primarily between the pupil and the instructor
  • However, the School reserves the right to enforce these Terms where necessary.

 

3. BOOKINGS & PAYMENTS

3.1 Booking Lessons

Lessons can be booked via:

  • Phone
  • Website
  • Online booking system (where available)

All bookings are subject to instructor availability.

3.2 Payments

Payments may be made:

  • Directly to the instructor, or
  • To Morden Driving School (where applicable)

We reserve the right to introduce centralised payment systems in the future.

You must obtain a receipt as Morden Driving School Ltd cannot accept responsibility for any payments to the Instructor. When making bookings, supplying any information or documentation to you and processing any payments the Morden Driving School Ltd may act as an agent of the Instructor.

3.3 Block Bookings & Refunds

  • Discounted block bookings are available
  • If a refund is requested:
    • Lessons already taken will be charged at the standard hourly rate
    • Remaining balance will be refunded accordingly

Any block booking must be used within 6 months of purchase, and you are not entitled to a refund for any lessons that are not booked and used within this 6-month period. You must obtain a receipt as Morden Driving School Ltd cannot accept responsibility for any payments to the Instructor.

When making bookings, supplying any information or documentation to you and processing any payments the Morden Driving School Ltd may act as an agent of the Instructor. Accordingly, you acknowledge that the Morden Driving School Ltd can have no liability to the Pupil in respect of any matter which is subject to the contract between the Instructor and yourself.

However, nothing in these terms shall exclude the liability of the Morden Driving School Ltd for any loss or damage directly occasioned by the negligence or other breach of the said company.

 

4. CANCELLATIONS & MISSED LESSONS

  • A minimum of 48 hours’ notice is required to cancel or rearrange a lesson
  • Lessons cancelled with less than 48 hours’ notice will be charged in full
  • Failure to attend a lesson (no-show) will also result in full charge.

 

5. INSTRUCTOR AVAILABILITY

If your instructor becomes unavailable:

  • We will aim to provide a replacement instructor
  • Where this is not possible, unused lessons may be refunded.

 

6. DRIVING TESTS & USE OF VEHICLE

  • Your instructor will determine when you are ready for your driving test
  • Use of the instructor’s car for the test is:
    • Subject to instructor approval
    • Based on your readiness and safety standard

Additional charges may apply for test-day use.

 

7. PUPIL RESPONSIBILITIES

You must:

  • Hold a valid UK provisional driving licence
  • Meet legal eyesight requirements
  • Be medically fit to drive
  • Not be under the influence of alcohol, drugs, or impairing medication

If these conditions are not met, the lesson will not proceed and may be charged.

 

8. BEHAVIOUR & SAFETY

We maintain a strict safety policy.

  • Any unsafe, abusive, or inappropriate behaviour will result in:
    • Immediate termination of the lesson
    • No refund

 

9. INSTRUCTOR CANCELLATIONS

If your instructor needs to cancel:

  • The lesson will be rescheduled at a mutually agreed time
  • We will aim to minimise disruption wherever possible

 

10. PRICING

  • Lesson prices may vary by instructor and location
  • Prices may be updated from time to time
  • Confirmed bookings will be honoured at the agreed rate

 

11. LIMITATION OF LIABILITY

  • Nothing in these terms excludes liability where unlawful
  • Morden Driving School is not liable for:
    • Test results
    • Losses arising from the instructor-pupil contract
  • We are not responsible for indirect or consequential losses.

 

12. NO GUARANTEE OF PASS

Passing your driving test depends on your performance and DVSA assessment.

We do not guarantee a pass.

 

13. DATA PROTECTION (GDPR)

We take your privacy seriously.

  • Your data is stored securely and used for:
    • Bookings
    • Communication
  • Your information may be shared with your assigned instructor.

 

14. DASHCAM & RECORDING

For safety and training purposes:

  • Lessons may be recorded using dashcams
  • This may include video and/or audio

By booking lessons, you consent to this.

 

15. COMMUNICATION

We may contact you via:

  • Phone
  • SMS
  • WhatsApp
  • Email

This is for booking updates, reminders, and service communication.

 

16. COMPLAINTS & DISPUTES

If you have a concern:

  • Please contact us in writing
  • We aim to resolve issues quickly and fairly
  • Formal escalation will be used where necessary

 

17. PAYMENT DISPUTES

We reserve the right to:

  • Challenge chargebacks or payment disputes
  • Use booking and communication records as evidence

 

18. CHANGES TO TERMS

We may update these Terms at any time.

Updated Terms will apply to all future bookings.
